The CNMV (Comisión Nacional del Mercado de Valores) applies the standard ESMA product-intervention tiers: 30:1 on major FX pairs, 20:1 on minor pairs/gold/major indices, 10:1 on other commodities/minor indices, 5:1 on individual equities, and 2:1 on crypto-assets, with mandatory negative balance protection. Compensation for a failed Spanish-registered investment firm runs through FOGAIN, covering cash and securities up to €100,000 per client. If you’re onboarded instead to an EU-passported broker’s home-country entity rather than a Spanish subsidiary (e.g. a Cyprus entity), coverage may fall under that country’s scheme, which can be significantly lower (Cyprus’s ICF, for instance, covers only €20,000).

Spain stands out on enforcement: in July 2023 the CNMV introduced a near-total ban on marketing CFDs and other leveraged products to Spanish retail investors, covering influencer and celebrity promotion, mass marketing such as webinars and cold outreach, demo-account funnels, and volume-based introducer commissions. CNMV has stated this applies even to brokers passporting in via other EU licences without a Spanish branch, and has coordinated directly with regulators like CySEC on enforcement. That’s a notably more aggressive stance on host-state marketing rules than most EU regulators take.
